In consideration of the monies recited and the mutual obligations contained herein, the Owner does hereby lease and rent to Tenant the property known as Indo House St John on the island of St John in the US Virgin Islands, under the following terms and conditions:

Reservation and Payment Requirements: Upon receipt of a reservation request for the Property more than 30 days in advance of check-in, the Tenant must make a payment equal to 50% of the total rent and applicable taxes within 48 hours after the reservation request. The remaining 50% balance payment is due no less than 30 days prior to check-in. If the reservation request is made less than 30 days prior to check-in, the total rent and taxes will be due on the day of the reservation request. By accepting and making the first payment, the Tenant acknowledges and consents to these policies.

Payment Methods: Payment can be made in US funds by credit card, check or wire transfer only. No other methods of payment will be accepted.

Taxes: Tenant shall pay an accommodation tax (VI Hotel Tax) of 12.5% of the total gross rent payment for all short-term guests to the Territory.

Tenant Damage, Insurance and Security Deposits: A credit card authorization for $10,000 will be held for damages and will be released within 2 days of departure, assuming no damages are reported.

Cancellations: There are no refunds for cancellations. Refunds or credits may be given on a case-by-case basis at the sole discretion of the Owner or Agent. All cancellation or transfer requests by Tenant must be in writing.

Non-availability of Property: In the event that the Owner cannot deliver the Property to Tenant at check-in for any reason, the sole remedy and maximum damages recoverable by the Tenant is the full refund of all funds previously received from Tenant less any fees paid to third parties for the benefit of Tenant as authorized by the terms hereof.

Evacuations: No refunds will be due to inclement weather, including hurricanes. Tenants must comply with any mandatory evacuation orders.

Other Refunds: No refunds will be given unless the Property is deemed uninhabitable at the time the Tenant is to begin occupancy. No amenities are guaranteed, and no refunds shall be granted for any interruptions that are beyond the Owner's control.

Animals: Pets are not allowed on the property without prior consent and will be approved on a case by case basis. Service animals are always welcome and allowed at Indo House St John.

Maximum Occupancy: Occupancy will be limited to the number specified in the rental agreement. Violation of this will result in eviction without refund.

Groups Not Allowed: Groups such as sororities, fraternities, student groups, etc., are not allowed. Misrepresentation will result in eviction without refund.

Acceptance of Policies: Payment of money or taking possession of the property after receipt of this agreement is evidence of acceptance of the agreement.

Expedited Evictions: Evictions will proceed as per the terms of the agreement in cases of overstaying, material breach, non-payment, or misrepresentation.

Representation: The Agent represents the Owner solely as Property Manager and Booking Coordinator.

Indemnification, Hold Harmless, and Release: Tenant agrees to indemnify and hold the Owner and Agent harmless from any liability for personal injury or property damage.

Competency: All parties to this agreement confirm they are legally competent to enter into this agreement.

Non-disparagement: The Tenant agrees not to publicly criticize the Owner or Agent.

Applicable Law, Jurisdiction and Venue: This agreement is governed by the laws of the US Virgin Islands.

Entire Agreement: This agreement constitutes the entire agreement among the parties.

Severability: If any provision of this agreement is declared illegal or invalid, the remainder of the agreement shall not be affected.

By making the initial payment, the Tenant acknowledges having read and understood all the terms and conditions of this Rental Agreement and agrees to comply with them. No signature is required as payment of the deposit and subsequent payments constitutes acceptance of this agreement.
